Summary
The invention concerned a “digital blue badge” for allowing disabled drivers and passengers to park closer to where they are going. The purpose of the electronic device is to replace the conventional paper badge which is susceptible to misuse and forgery. The hearing officer found that claim 1, when correctly construed and considering the common general knowledge of the skilled person, did not include an inventive step over the closest prior art. Moreover the claim included added subject matter not in the application as originally filed. As the compliance period had expired with no possibility of further extension, no amendment to the claims was possible. The hearing officer therefore refused the application.
