We have slowly entered 2022, which gives us a chance to take one last look at last week’s (and year’s) posts, in case you missed them!
TRADE MARKS
Remember the James Bond theme? Is it “too long” to be registered as a sound mark? Merpel and TechieKat Verónica Rodríguez Arguijo reported on a March 2021 decision of the Fifth Board of Appeal (R 1996/2020-5) of the European Union Intellectual Property Office (EUIPO) that answers this question.
The European Commission recently published the “Evaluation on geographical indications (GIs) and traditional specialities guaranteed (TSGs) protection in the EU” and our GuestKat Anastasiia Kyrylenko has provided her analysis with introductory background information and a review of the publication.
COPYRIGHT
Christmas was an opportunity to remember the novel “A Christmas Carol” by Charles Dickens, and PermaKat Neil Wilkof posted about the well-known author as a copyright influencer, explaining how the turkey became the holiday bird of choice on Christmas tables in England.
PATENTS
The DABUS case gave rise to a debate about whether artificial intelligence can be considered an inventor. GuestKat Frantzeska Papadopolou reviewed the recent decisions of the EPO’s Legal Board of Appeal in cases J 8/20 and J 9/20, which upheld the decisions of the EPO’s Receiving Section, both of which rejected the DABUS applications EP 18 275 163 and EP 18 275 174.
The decisions on DABUS applications are one of the cases mentioned in IPKat’s overview of the most important decisions of the EPO’s Boards of Appeal (BA) and EPO’s Enlarged Board of Appeal (EBA) in 2021, curated by our GuestKat Rose Hughes and available here and here.
GuestKat Rose Hughes also reported on the EPO user consultation on grace periods for patents, the results of which will be published on the EPO website in the coming months.
MISCELLANEOUS
The UKIPO recently published a report examining the influence of social media influencers on consumers and the link to the rise of counterfeit products in the UK. PermaKat Eleonora Rosati has analysed the main findings of the report, the empirical perspective, the legal angle and the policy discourse.
The European Commission’s Directorate-General for Taxation and Customs Union (DG TAXUD) and the European Union Intellectual Property Office (EUIPO) recently published the first joint annual report on “EU enforcement of intellectual property rights: results at the EU border and in the EU internal market 2020” and our TechieKat Verónica Rodríguez Arguijo reviewed it.
