Never Too Late: If you missed the IPKat last week!

Henry Yang released the second part of his analysis on the Interdigital v Lenovo FRAND judgement. The analysis focused especially on the Judge’s observation that InterDigital’s practice of heavy discounting for the past was due to two factors: the influence of limitation periods and the difficulty in recovering damages for infringement in many countries.

Marcel Pemsel discussed the decision of the German Patent Court in relation to a trade mark parody (30 W (pat) 15/19). The case concerned the application made by a private individual for the Germa trade mark British Hairways and the fact that British Airways filed an opposition on the basis of its EU trade mark. 

Eleonora Rosati discussed freedom of expression under EU trade mark law and the CJEU referral case in the context of proceedings brought by IKEA over the unauthorised use of its logo in the campaign of a political party. 

Katfriend Alessandro Cerri reported on the the injunction against copyright infringement in the case concerning Tesco’s infringement of the Lidl’s copyright in its blue-and-yellow logo.

Kevin Bercimuelle-Chamot reviewed the book ‘Copyright in the Street. An Oral History of Creative Processes in Street Art and Graffiti Subcultures’ authored by Enrico Bonadio. The reviewed considered the focus of the book, namely the evolution of US copyright law and street art graffiti.
