Rose Hughes reflected on the patent applications filed by Dr Thaler, which claim inventions purportedly invented by the AI machine, DABUS. There has been a lot of excitement about whether an AI can be formally designated as an inventor. In light of the EPO’s novelty, inventive step, and sufficiency objections, however, she wondered if the “inventing AI” has actually invented something patentable.
Chijioke Okorie reviewed Dr Emmanuel Oke’s book, Patents, Human Rights, and Access to Medicines (Cambridge University Press, 2022), which explores how the tension between patent rights and the right to health have been resolved in the decisions of national courts and tribunals in Kenya, India and South Africa.

Marcel Pemsel discussed the recent Jägermeister litigation in Austria and Germany. The well-known herbal liqueur brand went head-to-head with two other deer-branded alcoholic products. The trade mark infringement action succeeded in the Austrian Supreme Court, but not in the District Court of Hamburg.

Dua Lipa and Warner Music are being sued in California by talk box inventor and singer, Bosko Kante, who claims that he wrote and recorded vocal lines that were used in the remixes without his consent.
