The President of the European Patent Office (EPO),

Having regard to

  • Article 1 and 3 of the Decision of the President of the EPO of 17 November 2022 concerning countries and entities considered to ensure adequate protection of personal data (OJ EPO 2022, A111),
  • in particular of Articles 1(2)(a), (3)(1)(t) and 9(2) and (3) of the Data Protection Rules,

and

  • the Guidelines for the protection of personal data in the Unified Patent Court dated 10 February 2023,

Has decided as follows:

Article 1
Changes to Annex

The Unified Patent Court is added to the list of entities considered to ensure adequate protection in the Annex of the decision of the President of the EPO of 17 November 2022 concerning countries and entities considered to ensure adequate protection of personal data.

Article 2
Entry into force

This decision enters into force on 11 May 2023. It applies to any processing of personal data ongoing on or initiated after that date.
